TMZ and Fox News are reporting that yesterday, Los Angeles resident Lucie J. Kim filed a class-action law suit worth $4 billion against Miley Cyrus for that terrible picture.

According to the suit filed in Los Angeles Superior Court, Asian Pacific Islanders in Los Angeles (well over 1 million individuals) are each entitled to the minimum damages for a civil rights violation: $4,000. If you do the math, that’s around $4 billion. Sounds like enough to bankrupt Hannah Montana, and that’s only in the most forgiving scenario.

Lucie claims Miley, “…knew or should have known that her image would be publicly disseminated via the media, which Cyrus knew focused on her private life.”

Will this hold up? I’m not sure. It’d make one of us on the Ningin staff $4,000 richer if Ms. Kim & (big) co. win the suit. I’d miss out for being 40 miles away in Orange County. Regardless, it would be interesting to see this pull through. In the meantime, Director Michael Kang (Motel, West 32nd) has made a blog post on taking action by writing letters to Disney. Nothing riles up the entertainment industry like a good ol’ fashioned letter!

All of this is immensely amusing. If I had a legal background and was bored enough, I would do this too.

this is clearly just a publicity stunt meant to get the word out and to finally extort a mature, formal apology from miley herself - no money is going to be involved.

Agreed. Though I really would NOT mind making a profit off her ig’nance…

Well, I’d say that it’s because it was filed in an LA court, and that brings gravity to the case as Miley and more than one million people of Asian descent live in LA County, but that’s probably not why they didn’t apply this to all Asians. 

They would not take this law suit seriously if the class action applied to all Asians (is there really enough money in the world for that...?), whereas applying it to all Asians in LA is feasible. Granted, $4 billion is a buttload-and-a-half, but she is capable of covering those damages (whilst most likely losing all her assets).

Sounds crazy at first, but it’s a smart and ballsy move on Kim’s part. This isn’t about money. The lawsuit is a facade, and it’s about making Miley own up to the real weight of her actions (publicly), which she clearly has yet to do. Let’s hope money does it’s talking.
