The court has ruled in favor for boy band extraordinaire, DBSK. If you have no idea what’s going on, I’ll recap. DBSK filed a lawsuit against their parent company, SM Entertainment because the length of their contract was more than double the maximum length of 13 years. So what right?Job security? NOT exactly! The terms of the extended contract were tough to bear, clearly the boys were ill, sickly and never had any time off working non stop for 14 hours a day or more, while having to miss a large portion of their royalties, their lifestyles of wealth was merely a “front,” as claims such as gifts were merely borrowed.

So here’s the verdict, quoted from the source of Kbites:
“The court ruled partial disposition of the exclusive contract terms – to dispose of the SM Ent’s interference to the members’ independent unique activities and also contract to perform and other entertainment activities but the part about profit allocation will still have to stay.”

Addition from 121:
“this the news that I read in soompi the courts in favor of the boys, and they stated that the boys should be able to be more independent (meaning they can reject schedules that SM proposes and can do their own businesses without interference) but not move companies (meaning all the boys will be under SM!) However! This is not a final decision, and the exact, absolute one will come out in the near future. I hope u are no longer confused.”

In layman’s translation:

-Simply put, the boys will have the option to choose to rest instead of work in the case they are fatigued.
-They will also have the ability to continue promoting their own side businesses without SM butting in and robbing them of their profits, so long as it doesn’t use any promo material that belongs to SM including their band name, photos etc. –I guess that means SM’s CEO won’t be dining at Junsu’s pho restaurant.

However, the boys are stuck to their 13 year contract. Hey at least their burdens are lifted and they are able to continue without collapsing, or sustain injuries that overworked dancers experience.

But the question is, now that DBSK has sued their own employer, how differently will they be treated? Will there be a cold war? This also begs the question, how much other stuff under closed doors is going on in this company? Stay tuned for a further verdict to round 2 ruling, as finalization’s are incomplete.

yeah im kind of worried how things will be after its all finally settled, since im sure SM isnt happy with how this turned out.


I also heard from other translations that SM hasn’t paid them since February 2009 too. That’s a bleep bleep shame. Those guys work like dogs and SM treats them like that? These should be the very people that SM should pamper because they make a lot of money for the company.

I wonder if Avex pays them. Or do SM get paid by Avex? Because DBSK has been in Japan from the start of the year. This might be the reason why, but I’m not sure if Avex does pays them or not. I guess not :\

thats a good question, i remember reading it somewhere but i dont remember how the whole who pays who thing goes. i think it was that SM paid avex and avex pays TVXQ… but i dont remember for sure
